Oregon FMLA Lawyer

An Oregon FMLA lawyer helps workers whose leave was denied, cut short, or punished. Oregon runs three separate leave systems on top of each other. Paid Leave Oregon covers every employer in the state, the Oregon Family Leave Act covers larger ones, and federal FMLA sits above both.

Leave denied, or job gone when you came back? An Oregon FMLA lawyer will review it for free, with no obligation. Call today before it's too late.

Fired Unfairly works with Oregon FMLA lawyers who represent workers, not employers. Most people arrive here confused, and that is reasonable. Oregon rewrote how these laws fit together in 2024, and plenty of employers still apply the old rules. For the wider view, start with our Oregon employment lawyer page.

Which Leave Law Applies to You in Oregon?

Possibly all three, and the differences matter. Paid Leave Oregon applies to employers of any size. The Oregon Family Leave Act applies at 25 or more employees. Federal FMLA applies at 50 or more. Each covers different reasons for leave, and an Oregon FMLA lawyer sorts out which one governed yours.

Most workers who call have used the wrong name for what they took. They say FMLA when they mean Paid Leave Oregon, or the reverse. An Oregon FMLA lawyer untangles that first.

That matters because rights differ by system. An Oregon FMLA lawyer starts by identifying which law actually governed the leave you requested, since the wrong framing can sink a strong claim.

Eligibility differs too. Paid Leave Oregon looks at your earnings rather than your employer's headcount. OFLA looks at days worked and average hours. FMLA requires a year of service and 1,250 hours. An Oregon FMLA lawyer will check you against each test.

What Is Paid Leave Oregon?

A state program providing up to 12 weeks of paid leave in a benefit year, or 14 weeks for pregnancy-related conditions. It covers family leave, medical leave, and safe leave for survivors of domestic violence, stalking, harassment, or sexual assault. Every Oregon employer is covered, which gives an Oregon FMLA lawyer reach that federal law does not.

Eligibility is based on earnings, not employer size. If you earned at least $1,000 in your base year, you can qualify even at a two-person shop.

Job protection is separate from the benefit itself. Once you have worked for the employer 90 consecutive days, you are entitled to return to your position when the leave ends.

You can also top off the benefit with your own accrued paid time off to reach full wages. Your employer cannot refuse to let you do that, though many still try. Show the refusal to an Oregon FMLA lawyer.

What Does OFLA Still Cover?

Much less than it used to. Since July 2024, the Oregon Family Leave Act covers sick child leave, bereavement leave, pregnancy disability leave, and leave when a child's school or care provider closes during a public health emergency. Bonding and serious health condition leave moved to Paid Leave Oregon, and an Oregon FMLA lawyer sees employers still applying the old list.

This is the single most common source of confusion, and it produces real mistakes by employers still running old policies. Those mistakes become claims.

Bereavement leave is two weeks per family member, capped at four weeks a year, and it must generally be completed within 60 days of learning of the death.

Sick child leave now covers any illness requiring home care, not only serious conditions. That is broader than most parents realize, and it is worth raising with an Oregon FMLA lawyer if your absences were counted against you by an employer using the old standard.

Do OFLA and Paid Leave Oregon Stack?

They do, and that is unusual. Since 2024 the two cannot run at the same time, which means leave under one does not consume leave under the other. Used across a year, the combined job-protected time can substantially exceed 12 weeks. An Oregon FMLA lawyer will add it up correctly.

Employers frequently get this backwards. A company that tells you your 12 weeks are exhausted may be counting Paid Leave Oregon time against OFLA time it cannot legally combine.

Pregnancy is the clearest example. Pregnancy disability leave under OFLA sits apart from Paid Leave Oregon family leave for bonding, so those periods add together rather than overlap. An Oregon FMLA lawyer sees that miscounted constantly.

If you were cut off partway through, an Oregon FMLA lawyer will recount the weeks before accepting the employer's math.

Do You Get Your Job Back?

Yes, in most cases. Protected leave means restoration to your position, or an equivalent one with the same pay, hours, and duties. Your group health coverage also continues on the same terms as before, and an Oregon FMLA lawyer will check that too.

A quiet demotion is the most common violation here. The title survives, the pay survives, but the accounts are gone and the reports now go to someone else.

Write down what your job looked like before and what it looks like now. That side-by-side comparison is often the most useful document a client brings an Oregon FMLA lawyer.

Dropping your health coverage while you are out is a separate violation, even if everything else was handled correctly. It is worth raising with an Oregon FMLA lawyer on its own.

Who Counts as Family in Oregon?

A wider circle than federal law recognizes. Paid Leave Oregon reaches spouses and domestic partners, children, parents, siblings, grandparents, grandchildren, in-laws, and anyone whose close association is the equivalent of family. An Oregon FMLA lawyer can argue that last category.

That last category is genuinely broad and has no federal counterpart. Chosen family relationships can qualify, and an Oregon FMLA lawyer will make that case.

Federal FMLA is far narrower, limited to a spouse, child, or parent. So a worker denied leave to care for a sibling may have no FMLA claim and a solid Paid Leave Oregon claim.

If your request was denied because the person was not close enough family, tell an Oregon FMLA lawyer exactly how the denial was worded.

What About Paid Sick Time?

Separate again. Oregon requires 40 hours of sick time a year, paid at employers with 10 or more employees, and paid at six or more within Portland. Smaller employers must still provide the time unpaid and protected, and an Oregon FMLA lawyer treats a denial the same way.

Sick time can be used for your own illness, a family member's, preventive care, and since 2026 for approved blood donation.

Counting protected sick days against you under an attendance policy is a violation. That one shows up constantly in the write-ups that lead to a firing, and an Oregon FMLA lawyer will pull them.

What Does an Illegal Leave Denial Look Like?

Rarely an outright no. It looks like a request that goes unanswered, a demand for more medical detail than the law allows, a shift change on your return, or a write-up counting protected days as absences. An Oregon FMLA lawyer recognizes each version.

  • Telling you that you do not qualify without checking the right statute.
  • Requiring more medical documentation than the applicable law permits.
  • Counting protected leave against you under an attendance policy.
  • Ending health coverage during leave.
  • Filling your role and offering something lesser on return.
  • Contacting you with work assignments while you are out.
  • Combining OFLA and Paid Leave Oregon time to claim your leave ran out.
  • Firing you shortly after you requested or returned from leave.

Any of these can support a claim on its own. An Oregon FMLA lawyer will often find several in the same file.

How Long Do You Have to Act?

Shorter than Oregon's discrimination deadlines, which catches people. Leave-related retaliation claims under state law generally run one year. Federal FMLA claims run two years, or three when the violation was willful. An Oregon FMLA lawyer will map both clocks.

The five-year window Oregon gives harassment and discrimination claims does not extend to most leave claims. Assuming it does is a common and expensive mistake. Call an Oregon FMLA lawyer before the year runs.

You are not required to file with the Bureau of Labor and Industries first on state claims. You can go straight to court, or use BOLI if you prefer.

Public employers add notice requirements measured in months. If you worked for a city, county, school district, or state agency, move quickly.

What Is a Leave Case Worth in Oregon?

Damages generally cover lost wages and benefits, future lost earnings, emotional harm, and attorney fees. Punitive damages are available on state claims when the conduct was bad enough. Federal claims can carry a matching penalty on top of back pay, and an Oregon FMLA lawyer will plead whichever pays more.

The state claims usually carry more value. Federal law limits what you can recover for emotional harm, while Oregon does not.

Fee shifting matters here as much as anywhere. A company defending a modest leave claim can face a fee award several times the amount in dispute.

Value tracks your pay, how long you worked there, how quickly you found comparable work, and how clean the leave paperwork is on both sides.

What Should You Save?

Every leave request and every response, the medical documentation you submitted, your reviews from before and after, your pay records, and any write-up that appeared once leave entered the picture.

Note the dates precisely. When you asked, when the certification went in, when the employer replied, when you returned, and when anything changed. Leave cases are decided on sequence, so the dates are the first thing an Oregon FMLA lawyer asks for.

Save it outside work systems now. Access to email and payroll usually ends the same day the job does.

Oregon gives you a right to your personnel and pay records even after you leave, and an Oregon FMLA lawyer can send that request for you.

What Happens After You Call?

Four stages: sorting out which law applied, gathering records, filing, then negotiation or trial. Many cases end at stage two, once an employer sees the leave math an Oregon FMLA lawyer laid out correctly in a demand letter.

  • Sorting. Which system covered your leave, whether you were eligible, and which clock is running.
  • Records. Personnel file, leave file, certifications, pay records, and the employer's own written responses.
  • Filing. A BOLI complaint, a civil suit, or both, depending on the claim and the losses.
  • Negotiation or trial. Most cases settle, but the file gets built for trial, because employers negotiate differently with counsel prepared to try it.

Related claims travel with these regularly. A denial tied to a health condition may also be Oregon workplace discrimination. A firing at the end of leave may be Oregon wrongful termination. Punishment for asking is Oregon retaliation.

Do You Pay Anything Up Front?

Usually not. Most Oregon FMLA lawyers who represent workers take these cases on contingency, so no fee is owed unless you recover money. Reviews through Fired Unfairly cost nothing, and nobody should pay hourly to learn where they stand.

Contingency filters for claims with real evidence and measurable losses, which is why a firm may decline a leave dispute that was handled badly but not unlawfully.

Any Oregon FMLA lawyer you retain will put the fee terms in writing before you sign.

How Fired Unfairly Matches You With an Oregon FMLA Lawyer

Fired Unfairly is not a law firm. It is a free service. Describe what happened with your leave and we match you with an Oregon FMLA lawyer whose practice fits your claim, your industry, and the part of the state where you worked.

Fit matters on leave cases. A pregnancy leave dispute at a hospital is not a caregiver leave dispute at a warehouse, and public agencies run on different rules again. The right Oregon FMLA lawyer for you may not be in Portland.

Every lawyer in the network holds an independent license and answers for their own advice. Sending your facts here does not create an attorney-client relationship, and there is no charge or obligation.
